  • @StevenCrowder The reason the Senate approved the nomination was because originally the Senate was chosen by the States and the President was elected by the people so it would be a check/balanced between the will of the People and the States; now that the Senate is elected the point has been diluted

  • This is not a very good episode. I don’t understand the premise of the viewpoint. Is it to argue whether the senate has the authority? (it obviously does). Is it to argue whether she is the best person for the job? (that’s a very tough discussion for non-judiciary experts, it is not the same as discussing who is the best president etc). Is it to argue that the current president should not have exercised his right to nominate yet? (this is a discussion of whether he loses more votes that he wins with this course of action, which is probably the least uninteresting point to argue but no one is doing that and the viewpoint as stated is leading to “senate should confirm” not “president was correct to have nominated”)

  • TRUMPTARDS (is what the libs would say). Good, now I have your attention. I would avoid name calling but no one was responding to my previous comments. In my opinion, if the supreme court is overwhelmingly filled with people with a particular political stance (i.e 6-3 republicans-democrats) when the US population does not have that same overwhelming majority (and in fact, republicans lost the popular vote last election), then I feel that the system for selecting people must be flawed. A flawed system should be reworked. Packing the court is not a solution, except for the fact that doing so will destroy the system and force it to be reworked. When the ethics of a minority get to unilaterally dictate the way the majority live, there will be extreme unhappiness. If you allow some degree of balance or semblance of fairness, such as a reasonably balanced court representing the approximate ratio of views in the country, the resentment will be reduced. This is an argument for allowing the replacement to be a democrat. That way republicans can keep their 5-4 majority (despite not having the popular vote) and not have the system destroyed. IMO having a slight advantage is better than forcing a nuclear option from the democrats

  • Representative: make laws Executive branch: enforcement of the laws made by representatives Judicial: interpretation of the enforcement of those said laws. Supreme Court: hold those interpretations up too the constitution This is why we have appeals up too the Supreme Court Neither branch should make law, enforce law or judge the law. I know this is a tough job but the system works. Yes, the head of the executive branch has the ability to veto a law saying this branch will not enforce the law you brought too us. And the judicial branch says first, you broke this law that passed through both of these branches and other levels of court. Then the Supreme Court says if it then holds up too the Constitution. The constitution can be added to or change by a popular vote. That same popular vote put the representatives in place in the first place. This is how we are a democratic republic. We vote people to represent what is best for the country without trampling over the interests of the individual. This is a delicate balance. As we say in the military, one person will go out of his way to save his or her squad. But the squad was sacrifice their life to go out for that one person. The need of the many outweighs The need of the few. But it’s all responsibility to defend that one persons rights. It’s a delicate balance but it’s not rocket science people.

Adding more vacancies to the supreme court, let's say increase to 15, gives the president the ability to nominate 6 more justices than we have now. So automatically the balance of powered will be radically moved to whichever way the president wants it to be. That's bad for everyone. I understand why he may want a more balance of viewpoints in the court...but the problem. Is that packing the court would do the exact opposite of that instantly and to an extreme degree. But of course this is all assuming that th e senate majority is the same as the president. If opposing parties then it can just become an eternal fight for power
